Slough Borough Council has successfully prosecuted a land owner of a waste operation site for nearly £10,000 due to excessive noise after he failed to turn up to court 9 times.
Mr Amrik Johal, owner of Johal Skip Hire, Slough ran his noisy waste transfer site at 307-311 Colnbrook by pass and was served a noise abatement notice on 8 May 2008 by the council.
On December 18, he was found guilty at Maidenhead Magistrates Court of all five noise offences and fined £1,000 for each offence and £4,911 costs.
He was also successfully prosecuted by the Environment Agency for operating without a license.
Mr Johal’s case was heard in his absence after he failed to turn up for the 10th time owing to apparent ill health. However, he failed to submit medical evidence to support his absence on this occasion, so it was heard in his absence.
The local residents in the Slough area had suffered months of loud noise from the site in Colnbrook, with banging and smashing of materials and noisy vehicles using the premises. The site accepts waste from skips, along with scrap metal.
Diane Viechweg, team leader for neighbourhood enforcement team (South) at Slough Borough Council, said: “We are committed to ensuring residents do not suffer unduly with any noise which could spoil their home life.
“We are extremely pleased with the outcome of this case and hope it sends out a strong message to any other businesses operating in the area that we will not tolerate such conduct.”
Commissioner for Slough neighbourhoods and renewal, Cllr James Swindlehurst, added: “Residents have a right to enjoy peaceful surroundings around their homes, and we will take action against those who do not respect this right. Whether it is individuals or businesses, the Council has a track record of intervening and putting an end to nuisance noise in our neighbourhoods.”
